Our partner Diogo Nebias was interviewed by Agência iNFRA for its article on ANEEL's approval of the results of LRCAP 2026 (Capacity Reserve Auction in the form of Power), amid the legal debate that still surrounds the auction.
In Diogo's assessment, it is unlikely that a new court decision will overturn the auction as a whole, given the stage of the process and the commitments already made by project developers, the government, the agencies, the oversight bodies and the private sector. Any decisions are likely to be limited to specific issues, such as the situation of an individual bidder, without affecting the auction.
He also notes that litigation over public auctions is frequent in Brazil, but that first-instance decisions are rarely upheld by higher courts: the key point is always to identify at which level of the judiciary the decision was issued.
