In the judgment, the STF held that the Federal Court of Accounts (TCU) exceeded its powers by interfering in a regulatory matter that falls to the National Waterway Transportation Agency (ANTAQ), reinstating the agency's position on the matter.
As Diogo noted in the article, the decision reinforces the institutional logic of regulated sectors: the definition of technical rules should remain within the remit of regulatory agencies, which have the technical staff and expertise to deal with the specific operational and economic aspects of the port sector.
The discussion does not end the legal debate on the SSE charge, but it raises a relevant point about the limits of action between oversight bodies and regulatory agencies, a recurring issue in heavily regulated sectors.
