Our partner Tiago Severo Gomes was featured in a Valor Investe article on the new law that more explicitly allows the seizure, freezing and disposal of crypto-assets while still at the investigation stage.
Law No. 15,358/2026 reinforces that virtual assets are increasingly clearly within the reach of protective asset measures, including the possibility of freezing without a prior hearing, deferred adversarial proceedings and, in certain cases, provisional use or early sale, subject to judicial oversight.
For the market, the message is direct: this is not just a matter of criminal prosecution. It is also a matter of regulatory structuring, internal controls and compliance.
In the environment regulated by the Central Bank, the rules for SPSAVs and the provision of virtual asset services already require greater depth of governance, controls and prudential supervision.
In this scenario, the following points, among others, become even more relevant:
- procedures for complying with freezing and seizure orders;
- traceability and documentation of transactions;
- governance over custody and movement of assets;
- AML/CFT controls, monitoring and audit;
- protocols for preserving records and evidence.
For SPSAVs, compliance is no longer just a regulatory requirement and becomes a central element of risk mitigation, operational resilience and institutional protection.
That is precisely where compliance ceases to be merely a regulatory obligation and becomes an instrument of operational resilience, risk mitigation and institutional protection.
