In an interview with Valor Econômico, our partner Diogo Nebias, a specialist in capital markets and investment funds, noted that the investigation should lead firms to adopt an even more rigorous approach to due diligence.
"O que aconteceu nos leva a entender que houve um problema de detecção de origem de recurso, na hora de a empresa fazer uma checagem do passado do investidor, analisar o imposto de renda, saber de onde vêm os recursos. Então, o que pode acontecer agora são as gestoras e administradoras, por esse receio, serem mais criteriosas quando fizerem um fundo exclusivo." [What happened leads us to understand that there was a problem detecting the source of funds when the company checked the investor's background, reviewed income tax returns and established where the money came from. So what may happen now is that asset managers and administrators, out of this concern, will be more selective when setting up an exclusive fund.]
Diogo Nebias also warns that, in extreme situations, redemptions from open-ended funds may be temporarily blocked until the units linked to those under investigation are identified — underscoring the importance of swift asset segregation mechanisms.
The fund industry remains highly regulated and transparent, but the episode highlights the need for continuous improvement in governance and compliance.
