Our Partner Daphne Minerbo has prepared an article on the decision of the 3rd Panel of the STJ involving mutual asset protection (REsp No. 2,188,764).
The subject of the appeal was the deadline for payment of the indemnity, but the decision raised relevant points regarding the applicability of the CDC and the autonomy of the mechanism vis-à-vis traditional insurance.
There is also an aspect that deserves the attention of those who review participation agreements: the decision relies on the absence of SUSEP regulation, a gap that CNSP Resolution No. 491/2026 has already filled.
