Our Partner Tiago Severo Gomes was featured in an article by Valor Investe on the new law that now more explicitly allows the seizure, freezing and disposition of crypto-assets while still at the investigation stage.
Law No. 15,358/2026 reinforces that virtual assets are, increasingly clearly, within the scope of asset-securing measures, including the possibility of restraint without prior hearing, deferred adversarial proceedings and, in certain cases, provisional use or early sale, subject to judicial oversight.
For the market, the message is straightforward: this is not merely a matter of criminal prosecution. It is also a matter of regulatory structuring, internal controls and compliance.
In the environment regulated by the Central Bank, the rules governing SPSAVs and the provision of virtual asset services already demand greater depth of governance, controls and prudential supervision.
In this scenario, the following become even more relevant, among other points:
- procedures for complying with freezing and restraint orders;
- traceability and documentation of transactions;
- governance over the custody and movement of assets;
- AML/CFT controls, monitoring and auditing;
- protocols for preserving records and evidence.
For SPSAVs, compliance is no longer merely a regulatory requirement and becomes a central element of risk mitigation, operational resilience and institutional protection.
This is precisely where compliance ceases to be merely a regulatory obligation and becomes an instrument of operational resilience, risk mitigation and institutional protection.
