This decision is the first step toward Guardian's entry into the regulated environment.
Prior authorization and final approval: two stages, one path
The distinction between the two acts often causes confusion in the market.
- Prior authorization is SUSEP's initial ruling on the request. The agency reviews the corporate structure, the controlling shareholder, the business plan and the regulatory requirements, and grants prior authorization for the operation. From that approval, the company has a period, as a rule 90 days, to implement the operation and submit the corresponding administrative filing.
- Final approval is the last stage. SUSEP reviews the acts actually carried out, such as paid-in capital increases, amendments to the bylaws and proof of the required conditions, and then effectively authorizes the company to operate.
Guardian has now completed the final stage of this path.
Congratulations to the entire Guardian team!! May the journey be a very successful one.
We advised Guardian Seguradora S.A. throughout the entire process before SUSEP, with work by Roberto Panucci, Guilherme Teles and Fernanda Rangel
